India is
embarking on a major review of the Information Technology Act which was passed
with effect from October 17, 2000. Recent frauds of the Delhi MMS case and
Gurgaon BPO Cases have increased the demand from the media for "Stricter IT
Laws". In this scenario, Naavi.org is presenting a series of suggestions for
the consideration of the MCIT while addressing the amendments and request
comments from the public so that the Ministry will have the benefit of an
opportunity to consider the public views in this regard.
Suggestion
XV: Minor Modifications:
i)
In Section 2(r) and 2(v), the word “microfilm” may be deleted.
ii)
In Section 11 (a), the word “sent” may be replaced with “created or
sent”
iii)
Section 35 (3) may be deleted.
iv)
In Section 44(a) the words “or the Certifying Authority” may be
deleted.
v)
In Section 59, the words “its officers” may be replaced with “an
authorized representative of the appellant”
vi)
In Section 65, the word “Computer Source Code” may be replaced with
“data”. As a corollary, the paragraph on “Explanation” may be deleted.
(Alternatively, under the explanation, the word “or data” can be added before
the words “in any form”)
