Press Release Voluntary Cyber Law Compliance Programme for Cyber Cafes in Chennai In an environment of increasing Cyber Crimes in India, Cyber Cafes have often been used by Criminals to hide their identities and frustrate the Law Enforcement Authorities. Recognizing the need to enlist the support of Cyber Cafes in Crime Investigations, States such as Mumbai and Karnataka have passed separate legislations to register Cyber Cafes and impose mandatory production of photo identity cards for the visitors. Despite appreciation for the need for identifying Cyber Café users, the measures introduced in these States are yet to prove successful. Recognizing the positive role that Cyber Cafes can play in bringing the benefits of Internet to the masses through well maintained infrastructure for accessing the Cyber Opportunities in Business, Employment, Education and other forms of Information Services, Cyber Society of India (CySi) has embarked upon a project to educate Cyber Cafes about the prevailing Cyber Laws in India and guide them in taking steps in Voluntary compliance of Cyber Laws. The events following Bazee.com incident have also made some Cyber Cafes realize that if they do not demonstrate having observed “Due Diligence”, they may have to face liabilities arising out of Cyber Crimes happening through their network. However a majority of Cyber Cafes are not aware of the existing Cyber Laws and even those who are aware do not know how to demonstrate observance of “Due Diligence”. In order to assist such Cyber Cafes, CySi, has embarked on a “CyLawCom Audit and Certification” programme to ensure a benchmark level of Cyber Law Compliance for interested Cyber Cafes. Under this programme, trained CyLawCom auditors will undertake audit of Cyber Café facilities and assist them in setting up suitable systems in place to ensure a bench mark level of Cyber Law Compliance. Upon confirmation of compliance, a Certificate entitled “Certified E-Bridge Center” would be given to the Cyber Cafes recognizing their greater role in acting as an E-Bridge for Meta Society persons to access the benefits of the Cyber Society. The training of persons for CyLawCom audit with necessary skills is being undertaken by Cyber Law College, a constituent member of CySi, founded by Naavi the well known Cyber Law expert in Chennai. CySi of which Mr N.Vittal the former CVC is a patron, has embarked on several programmes aimed at creating Cyber Law Awareness amongst the relevant industry segments and has also developed an action programme to increase the level of Voluntary Cyber Law Compliance. It is launching a Cyber Law Compliance Certification programme for Cyber Cafes and Web Publishers including e-Group owners and Bloggers and is in the process of offering similar services for IT and Non IT Companies as well as E-Governance bodies. It is expected that such voluntary compliance programmes will contribute to a better level of Information Asset Security in the country and also develop a bench mark for “Due Diligence” expected from Cyber Society stake holders. In the light of the new generation of Cyber Crimes being committed with the use of Mobiles, it is felt that development of “Due Diligence” standards is essential for the industry players to protect itself from the ill effects of Cyber Crimes inadvertently committed through their networks or their employees.
