The Society is today
dependent on Information. In this era, a substantial part of the society's
wealth is in the form of Information Assets. Any loss or damage to this asset
therefore will cause a set back to the economy. The prime responsibility of any
Information Asset owner is therefore to protect his valuable asset.
Laws have been
promulgated by the Government to enable Information Asset owners to protect
their assets against criminals and to use the assets in a productive manner.
There is however a need for Information Asset owners to be aware of the laws and
what they need to do before and after an incident that causes or is likely to
cause a damage to their information asset.
Ironically however, it
is the very laws that are meant to protect the public that may be used by
criminals to take protection when the asset owner has been negligent and has not
complied with law.
A Law Non Compliant
Company therefore has no protection against vandals who damage their assets and
are also themselves liable for damages.
It is just like
a vehicle owner who drives in the wrong direction in a one way road and is
involved in an accident and suffers a damage. He is neither eligible for taking
action against the other driver, nor recover insurance. He is also likely to
face action himself for driving the wrong way.
Information Security
today is therefore not entirely a technical measure consisting of
Firewalls and Intrusion Detection Systems and does not end with Disaster
Recovery and Business Continuity Measures.
A time has come for
every Company whether they are in IT or non IT to undertake a Cyber Law
Compliancy Check and initiate measures to be Cyber Law Compliant. Ideally they
need to have a Cyber Law Compliance officer who is dedicated to provide the
Techno Legal Security advise to the Company on an ongoing basis while experts
are called in periodically for CyLawCom audits.
If Asset owners get
ready for CyLawCom audits, there is a need for CyLawCom examiners who can
undertake such examinations.
As a pioneer in
promoting the CyLawCom concept Cyber Law College is creating a provisional list
of "Register of CyLawCom" examiners.
Cyber Law College
