the interim judgement in the case of the Yahoo-India case, a copy of which
is available here and send in
their comments.
The case pertains to an objection to the use of www.yahooindia.com as a domain name because of its similarity with www.yahoo.com. If the arguement is true,then registration of yahoo as a trade mark in USA would provide an universal right on the domain names such as yahooindia,yahooaustralia etc etc. Now if this arguement is carried further, you cannot have a domain name as careerindia,expressindia,travelindia,messageindia, etc etc. Is it logical? I feel that as long as yahooindia.com doesnot try to pass itself off as yahoo itself, no offence should be recognized. At best, in recognition of Yahoo's position in the industry, yahooindia may be compelled to put up a prominent disclaimer that it is not part of Yahoo Inc, USA. Do you agree? or Disagree?...write to me your views. |
