P.S: On 23rd August, the Karnataka Government announced reversal of decision to cancel the admissions and has announced that the status quo would be maintained for admissions. The trauma is over for the current batch. The Admission Trauma in Karnataka
40000 students from all over India wrote CET exam in Karnataka this year for seats under what was called "Non Karnataka Quota". Each paid RS 500 each , a total of 200 lakhs.
Each of these 40000 attended the Counselling with their parent spending around RS 3000 each, a total of Rs 1200 lakhs.
Around 10000 students again attended the counselling session with their Parents spending another Rs 3000 each on an average, a total of Rs 300 lakhs.
4000 of them finally were admitted to various courses giving up whatever other options they had with them. They paid the requisite fees of around Rs 38000 for Engineering and much higher for Medical/Dental courses
And Now, Karnataka Government says that these 4000 students will not be given seats as they have abolished the Non Karnataka quota.
Government suggests that these candidates may be accommodated in the Management quota but does not admit that this would mean additional financial burden of around Rs 5 lakhs or more on average.
Government does not consider it illegal to rescind the written contract of admission issued by them to each of these 4000 candidates.
If all these 40000 students wrote the exam for zero seats, it means that this would be one of the biggest frauds committed by a Government on the public.
Imagine the consequences if a private sector Company had acted similarly and how RBI or SEBI or the Parliament would have reacted.
Naavi estimates that if each of these 40000 students claim compensation for the expenses they were made to incur under a false promise and each of the 4000 admitted students claim damages to the extent of the loss they suffer because of the Government's mishandling of the process, the total compensation payable by Karnataka Government would be around Rs 200 crores. If they refuse to pay the same it would amount to a fraud of RS 200 crores on the Indian public.
Is this what Supreme Court has ordered in its Judgement?
Or is it a wrong interpretation of the Karnataka Government?
..An answer would come when a clarification is sought from the Supreme Court itself.
